Area of Practice - Trading Standards


Members of Chambers have considerable experience at all levels of prosecuting criminal cases on behalf of Local Authorities. This experience extends to cases before both the Magistrates' Court and the Crown Court for offences embodied in a wide range of statutes and regulations, including the following:

  • Licensing Act 1964, section 169A(1); selling alcohol to minors;
  • Local Government (Miscellanous Provisions) Act 1976, section 16(2); failing to comply with a request for information where that information is needed to enable the Local Authority to perform its statutory functions;
  • Housing Act 1985, section 348G(1); failing to register a property that has been categorised by the Local Authority as a house in multiple occupancy (HMO);
  • Weights and Measures Act 1985, section 28(1); relating to the sale of goods;
  • Town and Country Planning Act 1990, as amended by the Planning and Compensation Act 1991; breaching Tree Preservation Orders;
  • Town and Country Planning Act 1990 and the Town and Country Planning (Control of Advertisement) Regulations 1992; displaying unlawful advertisements;
  • Town and Country Planning Act 1990, section 126; failing to respond to a notice requiring the recipient to improve the condition of land within the area;
  • Town and Country Planning Act 1990, section 179; failing to comply with an enforcement notice;
  • Environmental Protection Act 1990 and the Environmental Protection (Duty of Care) Regulations 1991; relating to the possession and disposal of controlled waste and fly-tipping;
  • Environmental Protection Act 1990, section 80; failing to abate a noise nuisance;
  • Property Misdescriptions (Specified Matters) Order 1992, made under the Property Misdescriptions Act 1991; relating to the misdescription of property in the context of the sale of buildings;
  • Trade Marks Act 1994; manufacturing, supplying and selling counterfeit products including CDs, DVDs and clothes;
  • Food Safety (General Food Hygiene) Regulations 1995, made under the Food Safety Act 1990; relating to the standard of hygiene expected in catering premises serving food to the public.
