Mark Weekes in Supreme Court appeal on "closed material procedures" in extradition
Mark Weekes is acting for CM, a Rwandan national whose extradition has been requested by the Rwandan authorities in relation to allegations of crimes against humanity arising from the 1994 genocide in that country. The Supreme Court is being asked to allow defendants in extradition proceedings to rely on evidence – not provided to the requesting authorities – which could show that if they are returned to Rwanda they are at risk of a ‘flagrantly unfair trial’. The application to call the evidence as part of a “closed material procedure” is on the basis that the witnesses who could give the relevant evidence are in fear of death or serious injury from agents of the state which has requested extradition. The substantive hearing before a District Judge at Westminster Magistrates’ Court is ongoing.
