Katherine Hardcastle acts for Liberty in judicial review of police stop and search powers

The Judgment has been handed down in a matter which sought to challenge the legality of police stop and search powers under section 60 of the Criminal Justice and Public Order Act 1994. This grants police officers additional powers to stop and search persons and vehicles for offensive weapons or dangerous instruments without the need to have grounds for suspicion. The appeal was unanimously dismissed, with the Court being satisfied that section 60 does not provide an arbitrary power and is “in accordance with the law”.
