Divisional Court considers availability of prevention of crime defence
The Divisional Court (Simon LJ and Sir Kenneth Parker) have handed down judgment in the case of R (DPP) v Stratford Magistrates Court & Ors  EWHC 1794 (Admin). The case was a judicial review of a District Judge’s decision to acquit eight defendants of obstructing the highway outside the Defence and Security Equipment International (DSEI) exhibition in 2015 on the basis they were acting to prevent crimes taking place inside.
David Perry QC appeared for the CPS in the appeal. Adam Payter acted for one of the defendants at trial and on appeal.
