Court stays Ann Summers private prosecution

An attempt to prosecute privately the well known adult retail store Ann Summers by a competitor was stayed as an abuse of the Court’s process at City of Westminster Magistrates’ Court. The District Judge criticised the prosecution as being an “affront to justice”, and had no hesitation in finding for the defence on all grounds. David Perry QC and Mark Weekes, instructed by Pinsent Masons, acted for the retail chain, and secured a very substantial costs order in favour of the defendant company.
